• If you’re using Infuzu on behalf of an organization, you confirm that you’re authorized to bind the organization to these Terms.

2. Who Can Use Infuzu

You must be 13 years or older to use Infuzu. If you’re under 18, you may only use our services with permission from a parent or guardian. You’re responsible for ensuring that your use of Infuzu complies with all applicable laws and regulations.

3. Your Account

To access certain features, you may need to create an account.

• Account Information: You agree to provide accurate and up-to-date information when creating your account.

• Security: You’re responsible for safeguarding your account credentials. Notify us immediately if you suspect unauthorized access to your account.

• Termination: We may suspend or terminate your account if we suspect a violation of these Terms.

4. Acceptable Use

By using Infuzu, you agree not to:

1. Use the services for any unlawful or harmful activity.

2. Attempt to access or disrupt Infuzu’s systems, networks, or other users.

3. Submit harmful or offensive content through the platform.

4. Reverse-engineer, modify, or attempt to extract source code from our software.

We reserve the right to investigate and take action against accounts that violate this section, including suspension or termination.

5. Paid Services

Some features of Infuzu may require payment.

• Billing: Payment is handled securely by Stripe. Infuzu does not store your payment information.

• Refunds: Unless required by law, all payments are non-refundable.

• Rate Limits: If you’re using our API, usage is subject to rate limits to ensure fair access for all users.

6. Data and Privacy

Your use of Infuzu is subject to our Privacy Policy, which explains how we collect, use, and protect your data.

• You retain ownership of the content you provide through our services.

• By using Infuzu, you grant us a license to use your content as necessary to provide and improve our services.

• For healthcare clients, additional privacy protections are available through our HIPAA-compliant Business Associate Agreements (BAAs).

7. Intellectual Property

Infuzu retains all rights, title, and interest in its services, including but not limited to software, design, trademarks, and branding.

• You may not use Infuzu’s intellectual property without our prior written consent.

• Feedback provided to Infuzu may be used to improve our services without obligation to you.

8. Service Availability

We strive to keep Infuzu available at all times but can’t guarantee uninterrupted access.

• Maintenance and Downtime: We may occasionally perform maintenance that impacts service availability.

• No Liability: Infuzu is not responsible for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the fullest extent permitted by law:

• Infuzu is not liable for indirect, incidental, or consequential damages, including loss of data or profits.

• Infuzu’s total liability for any claim is limited to the amount you paid for our services in the 12 months prior to the incident.

10. Indemnification

You agree to indemnify and hold harmless Infuzu, its employees, and affiliates from any claims, damages, or costs arising from:

• Your use of our services.

• Your violation of these Terms or applicable laws.

11. Changes to These Terms

We may update these Terms from time to time.

• Notice of Changes: Significant updates will be communicated through the platform or email.

• Effective Date: Continued use of Infuzu after updates go into effect constitutes your acceptance of the new Terms.

12. Governing Law and Disputes

• Governing Law: These Terms are governed by the laws of New York State, without regard to its conflict of laws principles.

• Dispute Resolution: Any disputes arising under these Terms will be resolved through litigation in a local court.

13. Termination

We may suspend or terminate your access to Infuzu if you violate these Terms or use the platform inappropriately.

• Upon termination, your rights to use Infuzu’s services will immediately cease.
